§ 1 Preliminary provisions
1. The owner of the Online Store Dorothy in Catland available at the Internet address www.dorothyincatland.com is K. Gryzka running a “unregistered activity” named Dorothy in Catland. Address of the place of business and address for delivery: Łętownia 124, 34-242 Łętownia, e-mail address: info@dorothyincatland.com, phone number: +48 502 301 333.
2. These Regulations are addressed to both Consumers and Entrepreneurs using the Store and define the rules of using the Online Store and the rules and procedure for concluding Sales Agreements with the Customer at a distance via the store.
§ 2 Definitions
1. Consumer – a natural person concluding a contract with the Seller as part of the Store, the subject of which is not directly related to its business or professional activity.
2. Seller – a natural person running “unregistered activity”: Dorothy in Catland. Address of the place of business and address for delivery: Łętownia 124, 34-242 Łętownia.
3. Client – any entity making purchases through the Store.
4. Entrepreneur – a natural person, a legal person and an organizational unit that is not a legal person, the separate law of which grants legal capacity, performs in its own name an economic activity that uses the Store.
5. Shop – online store run by the Seller at the Internet address www.dorothyincatland.com
6. Contract – a distance contract concluded with the Client as part of an organized system of concluding distance contracts (as part of the Store), without the simultaneous physical presence of the parties, with the exclusive use of one or more means of distance communication up to the conclusion of the contract, inclusive.
7. Regulations – these Regulations of the Store.
8. Order – Customer’s declaration of intent submitted via the Order Form and aiming directly at concluding a Product Sales Agreement or Products with the Seller.
9. Order form – an interactive form available in the Store that allows placing an Order, in particular by adding Products to the Basket and defining the terms of the Sales Agreement, including the method of delivery and payment.
10. Shopping Cart – an element of the Store’s software in which the Products selected for purchase are displayed by the Customer, and it is also possible to set and modify the Order data, in particular the quantity of products.
11. Product – a movable item available in the Store that is the subject of the Sales Agreement between the Customer and the Seller.
12. Sales Agreement – Product sales contract concluded between the Customer and the Seller via the Online Store.

§ 4 Technical requirements
To use the Store, including viewing the Store’s assortment and placing orders for Products, they are necessary:
a. device with access to the Internet,
b. active e-mail account (email),
c. enabled cookies service,
§ 5 General information
1. Seller is not legally responsible for disruptions and interruptions in the functioning of the Store caused by force majeure, unlawful activities of third parties or incompatibilities of the Online Store with the Customer’s technical infrastructure.
2. Browsing the Store’s assortment does not require creating an Account. Placing orders by the Customer for Products in the Store’s assortment is possible by providing the necessary personal and address data enabling the implementation of the Order without creating an Account.
3. The prices listed in the store are given in Polish zlotys and euros. The seller is exempt from the tax on the goods sold.
4. The final amount to be paid by the Customer consists of the price for the Product and the cost of delivery (including fees for transport, delivery and postal services), about which the Customer is informed on the Store’s pages when placing the Order, and when he is only willing to bind Sales Contract.
§ 6 The rules for placing orders
To place an Order you must:
1. Choose one of the available currencies: Polish zloty, euro;
2. Select the Product that is the subject of the Order, and then click “Add to cart”;
3. On the page “Shopping cart” you can check the shipping cost, then click “Proceed to checkout”;
4. Fill out the order form by entering the details of the order recipient and the address to which the delivery of the product is to be made, choose the type of shipment (method of delivery of the product if there is a choice) or enter the invoice data if you need.
5. Choose one of the available payment methods and, depending on the method of payment, pay for the order within a specified period, subject to § 7 point 3;
6. Click the button: “Place order”.
§ 7 Offered delivery methods, payment methods
1. The Customer may use the following methods of delivery or collection of the ordered Product:
a. Polish Post
2. The customer can use the following payment methods (WooPayments powered by Stripe):
a. Payment by bank transfer to the Seller’s bank account: Bank Pekao S.A., SWIFT BIC: PKOPPLPW, IBAN: PL52 1240 1574 1111 0011 4013 9276.
b. By electronic payment: credit card or debit card.
c. Through electronic payment available in the Store. Payment availability depends on the country from which the purchase is made and is activated through the Woocommerce Payments application. Possible payments include: giropay, Sofort, iDeal, P24, Bancontact, SEPA.
§ 8 Payment terms
Detailed information on delivery prices and accepted payment methods can be found in the sales summary on the “Shopping cart” page and before the transaction is finalized, on the “Order” page. The costs depend on the selected products and their destination. Costs are calculated before the order is accepted. This way, each customer can check the cost appropriate to the order and shipping location.
§ 9 Shipment date, delivery date, customs fees
1. Your purchase will be carefully packaged and sent within 1-3 business days.
2. Shipping can takes around:
a. Poland: 3-5 business days
b. Inside Europe: 7-10 business days
c. Other countries: 7-20 business days
Due to possible delays with Post Office I am unable to guarantee delivery by a specific date. Please order ahead od time for special event.
3. Customs and import taxes. Buyers are responsible for any customs and import taxes that may apply. I’m not responsible dor delays due to customs.
4. If there is information about a temporarily extended shipping date on the store’s home page (position above the products), this is superior and binding information.
§ 10 Execution of a sales contract and payment terms
1. Conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer has placed an Order using the Order Form in the Online Store in accordance with § 6 of the Regulations.
2. After placing the Order, the Seller immediately confirms its receipt and at the same time accepts the Order for execution. Confirmation of receipt of the Order and its acceptance for implementation shall take place by sending by the Seller an email to the Customer’s e-mail address provided at the time of placing the Order, which contains at least the Seller’s statement of receipt of the Order and its acceptance for implementation and confirmation of the Sales Agreement. Upon receipt of the above-mentioned message by the Customer, the Sales Agreement is concluded between the Customer and the Seller.
3. If the customer chooses:
a. payments by bank transfer, electronic payments or credit card payments: the Customer is obliged to make payment within 7 calendar days from the date of the Sale Agreement, otherwise the order will be canceled;
b. cash payment upon personal collection of the Product: the Customer is obliged to make a payment upon receipt of the Product within 7 days from the date of receipt of information about the readiness of the Product to be picked up.
4. If the Customer has chosen a delivery method other than a personal collection, the Product will be sent by the Seller within three working days (subject to subsection 4c and 5 of this paragraph) in the manner chosen by the Customer when placing the Order.
a. If you order Products with different delivery times, the delivery date is the longest given date.
b. In case of ordering Products with different delivery dates, the Customer has the option to request delivery of Products in parts or to deliver all Products after completing the entire order.
c. If there is information about a temporarily extended shipping date on the store’s home page (position above the products), this is superior and binding information.
5. The beginning of the delivery of the Product to the Customer is counted as follows: If the Customer chooses the method of payment by bank transfer, electronic payment or payment card – from the day the money is credited to the Seller’s bank account.
6. If the customer wants to pick up the Product in person, it will be ready for collection by the Customer within the time specified in the Product description. The Customer will be additionally informed about the possibility of picking up the Product by sending the appropriate e-mail message to the Customer’s e-mail address provided during placing the Order.
7. Product delivery takes place in Poland as well as the rest of the world.
8. The delivery of the Product to the Customer is payable, unless the Sales Agreement provides otherwise. The delivery costs of the Product (including charges for transport, delivery and postal services) are indicated to the Customer when placing the Order, including when the Customer wishes to be bound by the Sales Agreement.
9. Personal reception of the Product by the Customer is free.
§ 11 The right to withdraw from the contract
1. The consumer may withdraw from the Sales Agreement within 14 days without giving any reason.
2. The course of the period specified in § 11 point 1 begins with the delivery of the Product to the Consumer or to a person designated by him other than the carrier.
3. In the case of the Contract, which includes many Products, which are delivered separately, in batches or in parts, the period specified in § 11 point 1 runs from the delivery of the last item, lot or part.
4. The Consumer may withdraw from the Agreement by submitting to the Seller a statement on withdrawal from the Agreement. To comply with the deadline for withdrawal from the Agreement, it is sufficient for the Consumer to send a statement before the expiry of that period.
5. The statement may be sent by traditional mail or by electronic means by sending a statement to the email address of the Seller or by submitting a statement on the Seller’s website, the Seller’s contact details are specified in § 3.
6. In the event of sending a statement by the Consumer electronically, the Seller shall immediately send the Consumer, at the email address provided by the Consumer, a confirmation of receipt of the statement on withdrawal from the Agreement.
7. Effects of withdrawal from the Agreement:
a. In the event of withdrawal from the Contract concluded remotely, the Agreement shall be considered void.
b. In the event of withdrawal from the Agreement, the Seller waits for the return of the Product purchased by the Consumer. The Seller shall assess the condition of the Product, if it finds no damage, immediately, no later than within 14 days of receipt of the Product returns to the Buyer: the cost of the purchased Product, without delivery costs and without additional costs incurred by the Buyer by sending the Product.
c. The reimbursement will be made by the Seller using the same payment methods as were used by the Consumer in the original transaction, unless the Consumer has explicitly agreed to another solution which will not entail any costs for him.
d. The consumer should return the Product to the address of the Seller specified in these Regulations immediately, not later than 14 days from the day on which he informed the Seller about the withdrawal from the Agreement. The deadline will be respected if the Consumer sends the Product back within 14 days.
e. The Consumer bears direct costs of returning the Product.
f. The consumer is responsible for the destruction of the Product resulting from improper use of it. The seller will assess the damage and reduce the value of the Product. The refund of purchase costs will be reduced in percentage, adequately to damages.
g. The consumer bears the costs of product damage resulting from the careless packaging of the Product sent back to the Seller.
8. The right to withdraw from a distance contract is not entitled to a Consumer with respect to the Contract:
a. in which the subject of the service is a Product manufactured according to the Consumer’s specification or serving to satisfy his individual needs;
b. for the provision of services, if the Seller has fully provided the service with the express consent of the Consumer who has been informed before the provision begins that after fulfilling the service by the Seller, he will lose the right to withdraw from the Agreement,
c. in which the price or remuneration depends on fluctuations in the financial market, over which the Seller has no control, and which may occur before the deadline to withdraw from the Agreement,
d. in which the object of the benefit are things that after delivery, due to their nature, are inseparably connected with other things,
§ 12 Reclamation and warranty
1. The New Products are covered by the Sale Agreement.
2. The seller is obliged to provide the customer with a product free from defects.
3. In the event of a defect purchased from the Seller of the goods, the Customer has the right to make a complaint based on the provisions concerning the warranty in the Civil Code.
4. Complaints should be reported in writing or by e-mail to the addresses of the Seller provided in these Regulations.
5. The seller will respond to the claim immediately, no later than within 14 days, and if he does not do so within this period, it is considered that the client’s request was considered justified.
6. Goods sent as part of the complaint procedure should be sent to the address given in § 3 of these Regulations.
§ 13 Out-of-court ways to handle complaints and redress
1. Detailed information on the Consumer’s possibilities of out-of-court settlement of complaints and rules of access to these procedures is available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Wojewódzkich Inspektoratów Inspekcji Handlowej and the following Internet addresses of the Office of Competition and Consumer Protection::
§ 14 Personal data in the Online Store
1. The administrator of personal data of Customers collected via the Online Store is the Seller.
2. The seller collects the Customers’ personal data thanks to the appropriate software ensuring high security of data confidentiality.
3. Customers’ personal data collected by the administrator via the Online Store is collected in order to implement the Sales Agreement, and if the Customer agrees to it also for marketing purposes.
4. The recipients of personal data of the Online Store customers are:
a. In the case of a Customer who uses the Online Store with the method of delivery by courier or Polish Post, the Administrator provides the Customer’s personal data collected to a selected carrier or intermediary performing the shipment at the request of the Administrator.
b. In the case of a Customer who uses the Online Store from personal collection, the Administrator provides the collected personal data of the Customer to the owner of the collection point.
c. In the case of a Customer who uses the Online Store with electronic payments, the Administrator provides the Customer’s personal data collected to a selected entity servicing the above payments in the Online Store.
5. The customer has the right to access their data and correct them.
6. Providing personal data is voluntary, but failure to provide the personal data specified in the Regulations necessary to conclude a Sales Agreement results in the inability to conclude this contract.
§ 15 Product Safety
The Seller ensures that all products offered in the store Dorothy in Catland comply with the safety requirements set out in the General Product Safety Regulation (GPSR). Before products are made available for sale, a risk assessment is conducted, and compliance documentation is prepared. Information contained in Product Cards.

§ 16 Additional Information on Consumer Responsibility
The Seller is not liable for damages resulting from improper use of the products, particularly if used in a manner inconsistent with their intended purpose or the provided instructions.
§ 17 Final Provisions
1. Contracts concluded via the Online Store are concluded in Polish or English.
2. The Seller reserves the right to make changes to the Regulations for important reasons, ie changes in the law, changes in payment methods and deliveries to the extent to which these changes affect the implementation of the provisions of these Regulations. The Seller shall inform the Customer about each change at least 7 days in advance.
3. In matters not covered by these Regulations, generally applicable provisions of Polish law shall apply, in particular: the Civil Code; Act on the provision of electronic services; Consumer Rights Act, the Act on the Protection of Personal Data.
4. The customer has the right to use extrajudicial means of dealing with complaints and redress. To this end, it may lodge a complaint via the EU ODR internet platform available at the address:
